Dairy Farmers of Britain Limited (Receivers and Managers Appointed) - Suppliers Section

Frequently Asked Questions from Suppliers

Q. What has happened?

A. On Wednesday 3 June 2009 Receivers & Managers were appointed to Dairy Farmers. A Receiver & Manager is someone who takes control of a company's affairs when it is in financial difficulty and tries to find a longer-term solution to those difficulties.

Q. Why have Receivers & Managers been appointed?

A. Following the loss of a material contact with the Co-op, the costs of reshaping the business could not be borne by the farmers without untold hardship to the dairy industry.

Q. Will I get paid for services or goods I have already provided?

A. You should file a claim with the Receivers & Managers and details of this process will be forwarded to all suppliers at the appropriate time however, at this stage it is unlikely that there will be a dividend to the unsecured creditors. The Receivers & Managers' staff will be contacting you regarding goods supplied after their appointment. You will be paid on normal terms for any goods and services provided after 3 June 2009 against a signed Receivers & Managers' purchase order.

Q. I have goods on site for which I have not been paid. I am coming to take them away as I retain title to all goods provided until I am paid.

A. You are not entitled to take away these goods until the Receivers & Managers have determined retention of title issues. This involves a process of identifying the stock and reviewing the supply terms. Please contact a representative of PricewaterhouseCoopers on 0113 289 4000.

Q. Should I continue providing service or supplies and how do I know I will be paid?

A. Dairy Farmers will continue to trade and therefore it is likely that the goods or services you provide will be required. The Company will pay for goods and services rendered to the business after 3 June 2009 against an appropriately authorised purchase order.

Q. Will the Receiver & Manager provide me with a guarantee?

A. No, it is not the policy of the Receiver & Managers to provide any form of guarantee.

Q. What is the likely return to unsecured creditors?

A. At this stage it is highly unlikely there will be a return available to unsecured creditors.

Q. Can I see a list of creditors?

A. A list of creditors is not available. A report will be posted on this website which will provide further details in early September.

Q. Where should I file my claim?

A. Suppliers should send a statement of any amounts owed to them to The Joint Receiver & Managers, Dairy Farmers of Britain, c/o Benson House, 33 Wellington Street, Leeds, LS1 4JP.
