Expert valuation services

We have extensive experience in providing independent, expert advice and formal opinions on value in circumstances where there are unresolved questions or disagreement over value, for example:

• Shareholder disputes - for example, disagreement over the share price to be offered to a departing shareholder
• Professional negligence - identifying and quantifying the impact on value
• International arbitration - for example, assessing the quantum of damages owing to a party due to breach of contract or expropriation of assets
• Corporate litigation - including assessing quantum in respect of breach of contract or warranty by corporates, particularly in relation to transactions
• Minority oppression - identifying the issues and assessing damages, or identifying an appropriate transaction price, associated with the oppression of minorities (for example, s459 claims)
• Matrimonial disputes - valuing the business interests of one or both parties, and addressing issues such as liquidity and marketability
• Minority interests in private companies - for example for the purposes of establishing an internal market in shares or management incentive schemes

Our dedicated team of valuation specialists work closely with colleagues in Forensic Services as well as other industry and technical specialists (for example pensions and taxation) to provide expert valuation services, including:

• Expert witness services, including the preparation of expert reports for court and international arbitration purposes, appearing as an expert witness and providing litigation support; and
• Expert determination of value in accordance with Shareholder Agreements and Articles of Association.

The team's extensive experience and ability to draw upon a wide range of specialists means that the analysis and reports are robust and comprehensive and capable of withstanding scrutiny by opposing experts and the court.

The team is familiar with the requirements of CPR 35, regularly works with legal teams and other experts and understands court timetables and processes. A number of the team have provided oral testimony to the High Court, Arbitration Tribunals and the Lands Tribunal.
