The draft Finance Bill 2012 legislation was published on 6 December 2011. The Government’s aim is to make the UK a more attractive place to do business and deliver a more competitive tax system. George Osborne hopes to achieve this by simplifying reliefs and allowances, tackling avoidance and lowering corporate tax rates.

Also in this edition, we outline how The European Court of Justice (ECJ) has decided that German dividend taxation, with respect to withholding taxes for non-resident companies, isn’t in line with the free movement of capital. There may be an opportunity to claim withholding tax refunds, if you’re a recipient of German dividends.

The ECJ has also held that the UK exemption for betting and gaming breached fiscal neutrality in the way it treated similar activities differently.
