This update relates to the Claim Resolution Agreement (the "Agreement") which was declared effective on 29 December 2009 by Lehman Brothers International (Europe) (in administration) ("LBIE") in respect of certain of its clients and counterparties. For further information on the Effective date please see the Client Assets Update of 29 December 2009.
In recognition that a number of clients have had logistical issues over the festive period, LBIE has decided to make a Further Offer under Schedule 1 to the Agreement, on the same terms as the Offer, to those Eligible Offerees who did not submit a Form of Acceptance. Forms of Acceptance relating to the Offer must be received by the 21st of January at 5:00pm (London time) and will be treated in respect of the Further Offer in the same manner as set forth in the Terms and Conditions of the Offer, Schedule 1 of the Agreement, as those received prior to the Effective Date.
If you are an Eligible Offeree and you wish to accept the Further Offer, you must complete and submit a Form of Acceptance to LBIE by sending a scanned copy by email to generalqueries@lbia-eu.com, or by faxing a copy to +44 (0)20 7067 8542, as soon as possible and in any event so as to be received by LBIE no later than 5.00 p.m. (London time) on Thursday 21 January 2010.
After you have submitted your Form of Acceptance by email or fax, you must send the original by pre-paid post or air mail to the Company as soon as possible to: Lehman Brothers International (Europe) (in administration), Trust Property, 24th Floor, PO Box 62492, London, E14 1JX, United Kingdom or, if you are sending by courier only, to: Lehman Brothers International (Europe) (in administration), Trust Property, 24th Floor, 25 Bank Street, London, E14 5LE, United Kingdom (marked for the attention of E. Levy).
The Joint Administrators remain of the opinion that the Agreement represents the most efficient method of returning trust assets to clients of LBIE.
