Update – Application to Court for directions in respect of a settlement of the Waterfall III proceedings – 8 September 2017

Following previous announcements in relation to the proposed settlement of the Waterfall III proceedings, the Joint Administrators are pleased to report that the settlement became effective on 6 September 2017 and that, in accordance with the terms of the settlement, the Joint Administrators have filed at Court a Consent Order providing for the Waterfall III applications to be dismissed.

The Joint Administrators have updated this notice to include a copy of the sealed Consent Order which was approved and sealed by the Court on 20 December 2017. This confirms that the Waterfall III Application (and related cross application) have been dismissed, a link to the sealed Order dated 20 December 2017 can be found here.
