Lehman Brothers International (Europe) (in administration) - client money and assets update 29/05/2009

On 29th May 2009, the Joint Administrators wrote to clients for whom, it appears from LBIE's records, LBIE segregated client money on 12th September 2008 (based on data as at close of business on 11th September 2008).  The letter follows the letter sent on 12th May 2009.  The 29th May letter indicates a US dollar range of how much client money appears to have been segregated for the recipient on 12th September.  The letter also indicates, based on LBIE's records, which client money components made up this segregated client money.

All clients who receive the 29th May letter should also have received the letter of 12th May.  However, certain clients who received the 12th May letter may not receive the letter of 29th May.  In respect of such clients, LBIE will typically have received client money relating to them during the course of 12th September and as a result, those clients would not have been included in LBIE's segregation exercise performed on the morning of 12th September (which, as noted above, was based on data as at close of business on 11th September).  These clients may still be entitled to make a claim against the client money pool, although their claims may turn on the determination of certain issues which are the subject of the Joint Administrators' application to the High Court seeking directions concerning LBIE's obligations in relation to the handling of pre-administration client money (the "Application").

The purpose of the 29th May letter is to provide recipient clients with further assistance in determining whether or not they would like to make representations in connection with the Application.  You are reminded that if you do wish to make representations you must notify the Joint Administrators of this no later than 4pm on 12th June 2009.

Please note that because the 29th May letter contains client specific information one copy has been sent to each specific client (ie to each unique GAC reference).  A minority of clients may therefore receive multiple letters and each of these should be reviewed.
